We want to bring you a case today that focuses on a medical malpractice case involving a child’s injury, except that child is now an adult.
Lacy Povrzenich is 22-years-old now, but she has had kidney problems since she was a child. When she was 17-months-old, she began to see Dr. Dawn McCracken after she kept getting urinary tract infections. McCracken performed blood work which returned levels indicative of kidney impairment or injury. However, nothing was done concerning treatment for her kidneys.
In 2009, Lacy saw a physician’s assistant and had high blood pressure readings during two visits. There was no follow up for the blood pressure results.
Two weeks later, she had to be flown to Pittsburgh’s Children’s Hospital where she was diagnosed with end-stage renal failure. She did get a transplant, but a jury found the doctor to be 85% responsible for her injuries and the facility she visited to be 15% responsible. The total settlement amount was $4,242,573.

The above story may not present itself as a child injury, but it was. The doctors and facilities involved were responsible for providing a high level of care yet they did not. They offered a missed diagnosis of a condition that ended up costing Lacy dearly. The pain and suffering she endured is tragic.
When it comes to injuries to children, you probably think of traumas. That is because children tend to get themselves into situations that the people who care for them need to be aware of. Consider how many people are responsible for your child’s well-being.
All of these people need to be well-trained and alert at all times. If they are negligent in their duties, a child could be seriously harmed.
Aside from medical mistakes and personal negligence, there were other ways that children can get harmed. One of those ways is due to faulty products.
Think about all of the items your kids use on a daily basis: toys, foods, medications, bikes, markers, and more. It is up to the companies that make these items to ensure that they are selling safe items. If there is a fault with the product or if the product is mislabeled, a company could be held liable for any injuries.
If your child has been injured due to the negligence of another person, please seek legal assistance as soon as possible. We know that this is an incredibly stressful thing to be dealing with. Your focus needs to be on helping your kid, not worrying about how you will cover all of the incoming expenses.
At Shenderovich, Shenderovich & Fishman, we will work tirelessly to secure the compensation you deserve for all of the injury-related expenses. This can include:
